Gulf Restoration

BP's civil settlement "consent decree" was finalized this week. Environmental Law Institute has a useful summary of the $16.7B settlement.  

On April 4, 2016, nearly 6 years after the Deepwater Horizon exploded and spilled millions of barrels of oil into the Gulf of Mexico, BP and Justice finalized terms for civil claims bringing BP's total payments to $20.8 billion. As described by the Justice Department, "This historic settlement resolves the U.S. government’s civil penalty claims under the Clean Water Act, the governments’ claims for natural resources damage claims under the Oil Pollution Act, and also implements a related settlement of economic damage claims of the Gulf States and local governments" (DoJ settlement page).

On March 28, 2016, Elizabeth (Libby) Fetherston assumed leadership of the Florida RESTORE Act Centers of Excellence Program (FLRACEP). Libby has spent the past five years with the Ocean Conservancy fighting for Gulf environmental recovery and has a strong resource management and conservation background.

The Environmental Law Institute's Ocean Program continues to develop informative resources to keep stakeholders updated on Gulf of Mexico recovery efforts. Their new Introduction to Gulf Recovery provides easy access to many of these resources.

Following last month’s release of the Final Programmatic Damage Assessment and Restoration Plan and Final Programmatic Environmental Statement, the Natural Resource Damage Assessment Trustees have issued a Record of Decision. This explains their decision to select the comprehensive, integrated, ecosystem restoration alternative evaluated in the plan as their approach for restoration implementation. If the court approves the global settlement currently filed by the Department of Justice, the Trustees can begin to develop project-specific restoration plans based on the guidelines established by the final plan.
